LIMITED SCOPE REPRESENTATION AGREEMENT
This Limited Scope Representation Agreement (“Agreement”) is between the “Law Firm” (designated below) and You (“Customer”, “Client”, “You”, or “Your”) (together the “Parties”) for the limited advisory services described below through the Law Firm. Online Divorce Service, LLC and its parents, subsidiaries and/or affiliated entities (“Divorce Partner”) are not lawyers or law firms and are not parties to this Agreement. You agree our Divorce Partner is not liable for services performed pursuant to this Agreement.
A limited scope representation means that the amount of work the Law Firm, through its attorney, performs for you is limited to certain tasks defined in this Agreement. Limited scope representation is a means to provide access to legal services while making legal help affordable. The remainder of tasks required outside the scope of this Agreement, if any, will be your sole responsibility. For services outside of this scope, You may choose to hire Your Law Firm or another attorney to perform the additional tasks for additional fees.
THIS IS A LEGALLY BINDING CONTRACT. PLEASE READ IT CAREFULLY AND MAKE CERTAIN THAT YOU UNDERSTAND ALL OF THE TERMS AND CONDITIONS. EMPLOYMENT OF A LAWYER FOR LIMITED SCOPE REPRESENTATION REQUIRES THAT THE LAWYER AND CLIENT CAREFULLY AND THOROUGHLY REVIEW THE DUTIES AND RESPONSIBILITIES EACH WILL ASSUME.
This agreement is effective as of the date accepted by You.
Limited Legal Services
Client and Law Firm agree that the Law Firm is not engaged to represent Client generally in any matter, but rather, that Law Firm, will limit the scope of representation to only provide certain specific legal services in connection with the matter for a particular purpose (the “Limited Services”). Law Firm must act in your best interests and give you competent help. Because the Parties agree that Law Firm will provide only Limited Services: Law Firm does not have to give more help than agreed in this Agreement; any services provided will be at Law Firm’s sole discretion; and Law Firm does not have to help Client with any other part of the matter. Law Firm does not promise any particular outcome and relies entirely on Client’s disclosure of facts and will not make any independent investigation unless expressly agreed to in writing herein.
The Limited Services includes the following benefits:
- 45 minute telephone consultations with Law Firm, during published available hours, around divorce related matters.
This Agreement specifically excludes the following services:
- Law Firm will not represent, speak for, appear for or sign papers on Your behalf in any litigation related matter.
- Law Firm will not represent You in disputes with employees, contractors or third parties of any kind
- Law Firm will not provide litigation services of any kind, whether in court, arbitration, administrative hearings, or government agency hearings.
- Any action that directly or indirectly involves the Law Firm.
- Any adversarial matter that directly or indirectly involves another customer.
- Any matter involving the laws outside the jurisdictions of the United States.
- Any appeal to an appellate court.
- Any matter that, in the Law Firm’s opinion, is frivolous, or any case that is determined by the Law Firm to lack sufficient merit to warrant pursuit.
- Any other service not included as a Limited Scope Service under this Agreement.
Electronic Communication. You agree to receive communication by email from Law Firm. Law Firm is not obligated to send correspondence by US Mail.
Sharing Documents. You agree that Law Firm, to the extent allowable, may share information with Divorce Partner. Law Firm will never share or disclose attorney-client privileged information with Divorce Partner or other partners or vendors.
Professional Independent Judgment. Attorneys performing services under this Agreement are not agents or employees of Divorce Partner. Any attorney rendering legal services shall maintain the attorney-client relationship with the customer and is solely responsible to the customer for all legal services provided. It is within the sole discretion of the attorney to determine whether claims or defenses pertaining to any matter under this Agreement presents a frivolous or otherwise unmeritorious claim or defense. Participating attorneys and Law Firms reserve the right to make independent professional judgments regarding such presentations.
Dispute Resolution. Law Firm is committed to customer satisfaction. If you have a complaint about the services, please contact us by email at: support@theonlinedivorce.com. The conduct of individual attorneys is governed by the state bar of the jurisdiction where the attorney is licensed.
Fees & Billing. You agree that Law Firm may use the services of Divorce Partner to collect payment for the Limited Services herein and provide it directly to Law Firm. Any fees are earned on receipt and will not be billed against an hourly basis and will not be deposited in a client trust account.
Termination. If you purchased this service from Divorce Partner, cancellation or refund is subject to the agreement between you and those partners. Any cancellation or refund will terminate our attorney-client relationship
Conflict of Interest. Law Firm is required to inform you in writing if it has a client with an interest in your matter. If at any point, a conflict of interest is found between you and another client of Law Firm, then Law Firm may obtain written consent of both parties to proceed.
Entire Agreement. This Agreement contains the entire agreement of the Parties.
Lawyer services begin with the signing of this Agreement and terminate at the completion of the Limited Services requested and identified above.
